Finally, a Judicial Respite for Genarlow Wilson

The prosecution of Genarlow Wilson is an example of prosecutors and the law going amok. Wilson, who was 17 at the time, was caught in a government sting receiving consensual oral sex from his 15 year-old girlfriend. Under Georgia law, he received a jail sentence of 10 years. As the NY Times reported,
Under Georgia law, that offense qualified as aggravated child molestation, a felony charge largely intended for use against adult sexual predators, not teenagers like Mr. Wilson, who was 17 at the time of the incident. He had no prior criminal record and was an honors student and star athlete.
Genarlow was a high school football star and we cannot know how his imprisonment will hamper or destroy his potential football career. At least he has been released. But there an obvious need for the criminal justice system to distinguish between rape and consensual sex.
